Sotomayor is not fit for the Supreme Court
On Tuesday morning, President Barack Obama nominated Sonia Sotomayor as his choice to replace Justice David Souter on the United States Supreme Court. Sotomayor is currently serving as a circuit judge of the United States Court of Appeals for the 2nd Circuit. She is of Puerto Rican descent and was born in The Bronx. She was a graduate of Princeton University and Yale Law School and she claims to be Roman Catholic. Now, enough about this. Let's talk about what she's done as a judge.
First off, Sotomayor is against gun rights. She aparently is unaware of the Second Amendment to the U.S. Constitution. According to the National Rifle Association, she ruled in Maloney v. Cuomo that the Second Amendment does not apply against state and local governments. (NRA Web site)
Secondly, she is not going to judge according to the law, but instead from her "life experiences." Sotomayor said this: “I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life." (Quote within NY Times article)
Third, she is a racist. In a case about reverse discrimination within the New Haven, Conn. Fire Department. City officials threw out a promotion exam because no African Americans and only two Hispanic firefighters were likely to be make lieutenants or captains based on the results. Sotomayor sided with the city. White firefighters who would have been promoted, were not because they were white. This case is currently in the U.S. Supreme Court. (Newsday story)
Fourth, Sotomayor "joked" that on the Court is where policy is made. The Court is there to stand by the Constitution and not to make policy and make law.
Fifth, Sotomayor's decisions have been reversed 60 percent of the time by the Supreme Court. (Story by The Washington Times)
Sixth, and also very important. She ruled against the First Amendment in August 2007 in Doninger v. Niehoff. In the case, Avery Doninger was disqualified from running for school government at Lewis S. Mills High School in Burlington, Conn., after she posted something on her blog referring to the superintendent and other school officials as "douche bags" because they canceled a battle of the bands she had helped to organize. (Story from NBC Connecticut)
More is to come, I am sure of it. She is who Obama is. His mirror image. Obama says that there will finally be justice on the Court when she arrives.
